Terms & Conditions

1. Definitions

In these Terms & Conditions:

• "We," "Us," "Our," "Terra Luxe" refers to the vehicle rental service provider operating in Taichung, Taiwan
• "You," "Renter," "Customer" refers to the individual or entity renting a vehicle from Terra Luxe
• "Vehicle" refers to the automobile rented under this agreement
• "Rental Period" refers to the duration from vehicle pickup to return
• "Agreement" refers to these Terms & Conditions plus the signed rental contract
• "Service" refers to vehicle rental and associated support provided by Terra Luxe

2. Acceptance of Terms

2.1 Agreement Formation

By reserving or renting a vehicle from Terra Luxe, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. Your acceptance occurs when you sign the rental agreement or take possession of the vehicle.

2.2 Age and Capacity Requirements

To rent a vehicle, you must:

• Be at least 18 years of age
• Hold a valid driver's license from your country of residence
• Possess an International Driving Permit if your license is not in English or Chinese
• Have legal capacity to enter into binding contracts under Taiwan law
• Provide valid identification and payment method

3. Rental Services

3.1 Service Description

Terra Luxe provides vehicle rental services in Taiwan including sedans, crossovers, and SUVs for periods ranging from single days to full weeks. All rentals include comprehensive insurance, GPS navigation, and bilingual support.

3.2 Vehicle Availability

While we make every effort to provide the reserved vehicle type, availability is not unconditionally warranted. We reserve the right to substitute a vehicle of equal or higher category if the reserved vehicle becomes unavailable due to maintenance needs or unforeseen circumstances.

3.3 Geographic Restrictions

Vehicles may be operated throughout Taiwan. The following restrictions apply:

• Vehicles may not be taken off Taiwan's main island without prior written approval
• Some mountain passes may be restricted during adverse weather conditions
• Ferry transport to offshore islands requires advance notification and approval

4. Rental Obligations and Prohibited Uses

4.1 Permitted Use

Vehicles must be operated in accordance with Taiwan traffic regulations and used for lawful purposes only. You are responsible for complying with all applicable laws including parking regulations, speed limits, and traffic signals.

4.2 Prohibited Activities

The following uses are strictly prohibited:

• Operating the vehicle under the influence of alcohol or controlled substances
• Allowing unauthorized drivers to operate the vehicle
• Using the vehicle for commercial transportation or ride-sharing services
• Transporting hazardous materials or illegal goods
• Participating in races, rallies, or driving competitions
• Operating the vehicle on unpaved roads in standard sedans (SUV exceptions apply)
• Smoking or vaping inside the vehicle
• Transporting pets without prior arrangement and additional cleaning deposit

4.3 Vehicle Care

You agree to:

• Maintain vehicle cleanliness and report any mechanical issues immediately
• Check and maintain proper fluid levels including oil and coolant
• Secure the vehicle when unattended and protect against theft
• Report accidents or damage within 24 hours
• Return the vehicle in the same condition as received, normal wear excepted

5. Payment Terms and Fees

5.1 Rental Rates

Rental rates are quoted in New Taiwan Dollars (NT$) and include comprehensive insurance, GPS navigation, and support services. Rates are confirmed during reservation and may vary based on vehicle type, rental duration, and seasonal demand.

5.2 Payment Methods

We accept major credit cards including Visa, Mastercard, and JCB. A security deposit is required at vehicle pickup and will be processed on your credit card. The deposit is refunded upon satisfactory vehicle return, typically within 5-7 business days.

5.3 Additional Charges

Additional fees may apply for:

• Airport delivery coordination: NT$1,500 per service
• Late returns: NT$500 per hour beyond scheduled return time
• Fuel replacement if not returned at same level: Market rate plus NT$300 service fee
• Excessive cleaning required: NT$2,000-5,000 depending on condition
• Traffic violations or parking fines: Full fine amount plus NT$500 processing fee
• Lost or damaged GPS device: Replacement cost plus NT$1,000

5.4 Refund Policy

Cancellations and refunds are handled as follows:

• Cancellations more than 72 hours before pickup: Full refund
• Cancellations 24-72 hours before pickup: 50% refund
• Cancellations less than 24 hours before pickup: No refund
• No refunds for early returns or unused rental days

6. Insurance and Liability

6.1 Included Coverage

All rentals include comprehensive insurance covering collision damage, theft protection, and third-party liability as required by Taiwan law. This coverage is provided through licensed Taiwan insurance carriers and is included in the rental rate.

6.2 Coverage Exclusions

Insurance does not cover damage or loss resulting from:

• Prohibited uses as defined in Section 4.2
• Driver negligence or willful misconduct
• Operating vehicle with invalid license or while impaired
• Interior damage including upholstery, navigation system, or accessories
• Tire or wheel damage from improper use

6.3 Accident Procedures

In case of accident:

• Contact local authorities and obtain police report if applicable
• Notify Terra Luxe within 24 hours
• Do not admit fault or liability
• Cooperate fully with insurance investigation
• Provide all requested documentation including photos and witness information

7. Vehicle Return and Extensions

7.1 Return Requirements

Vehicles must be returned:

• At the agreed location and time specified in rental agreement
• With the same fuel level as at pickup
• In clean condition with no excessive dirt or damage
• With all provided equipment including GPS, cables, and documentation

7.2 Rental Extensions

Extensions are subject to vehicle availability. Contact us at least 24 hours before scheduled return to request an extension. Extension rates may differ from original rental rates and will be confirmed upon request approval.

7.3 Late Returns

Returns more than 1 hour late without prior approval incur late fees of NT$500 per hour. Failure to return vehicle within 48 hours of scheduled return without communication may be reported as theft to local authorities.

8. Limitation of Liability

8.1 Service Provided "As Is"

While we maintain vehicles to high standards, rental services are provided "as is" without warranties beyond those required by Taiwan law. We do not warrant that vehicles will be free from all mechanical issues or that GPS navigation will be error-free.

8.2 Disclaimer of Consequential Damages

Terra Luxe is not liable for indirect, consequential, or incidental damages including lost profits, travel delays, or business interruptions resulting from vehicle rental or mechanical issues. Our liability is limited to direct damages not exceeding the total rental fee paid.

8.3 Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond reasonable control including natural disasters, typhoons, earthquakes, government actions, or other acts of force majeure.

9. Dispute Resolution and Governing Law

9.1 Governing Law

This Agreement is governed by the laws of Taiwan. Any disputes arising from or relating to this Agreement shall be resolved in accordance with Taiwan legal procedures and jurisdiction.

9.2 Jurisdiction

The courts of Taichung, Taiwan have exclusive jurisdiction over any disputes arising from this Agreement. By entering this Agreement, you consent to the jurisdiction of Taichung courts.

9.3 Informal Resolution

Before pursuing formal legal action, we encourage informal resolution through direct communication. Contact us at [email protected] to discuss concerns or disputes.

10. General Provisions

10.1 Entire Agreement

These Terms & Conditions together with the signed rental agreement constitute the entire agreement between you and Terra Luxe. They supersede all prior discussions, negotiations, or agreements.

10.2 Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions continue in full force and effect. Invalid provisions will be modified to reflect original intent while maintaining enforceability.

10.3 Waiver

Failure to enforce any provision does not constitute waiver of that provision or our right to enforce it subsequently. All waivers must be in writing to be effective.

10.4 Assignment

You may not assign or transfer your rights or obligations under this Agreement without our written consent. We may assign this Agreement to affiliated entities or successors in business operations.

10.5 Notices

All notices related to this Agreement should be sent to [email protected]. Notices are effective when received.

11. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes become effective:

• 30 days after posting updated terms on our website
• Immediately upon notice for changes required by law or regulation
• Upon your next rental for non-material administrative updates

Your continued use of our services after changes indicates acceptance. Material changes affecting existing reservations will be communicated via email.
